PRIVACY AND COPYRIGHT POLICY

Statement of Privacy Policy

In compliance with Republic Act (RA) 10173, otherwise known as the Data Privacy Act (DPA) of 2012 and its Implementing Rules and Regulations (IRR), the Department of Trade and Industry’s Bureau of Philippine Standards (DTI-BPS) hereby specifies how it manages and protects the personal information it obtains from handling the sales of Philippine National Standards (PNS) and International Standards. The DTI-BPS commits to ensure the privacy and security of the personal information of all its clients and to comply with all issuances of the National Privacy Commission (NPC) in its implementation of the DPA.

Personal Information

The DTI-BPS collects the following personal information whenever clients purchase Philippine National Standards (PNS) and/or International Standards either via the PNS Catalogue in the BPS Standards and Conformance Portal (http://www.bps.dti.gov.ph/) or through walk-in or through online:

a. Full names
b. Company Names
c. Company Addresses
d. Telephone and/or Mobile Numbers
e. Email addresses 


Use of Data

The DTI-BPS assures its clients that all collected personal data is utilized for processing and documentation purposes only. Only authorized DTI-BPS personnel have access to these personal information and such are not shared with any outside parties, unless ordered or permitted by law. The data gathered will be stored in the DTI-BPS database for five (5) years, after which physical records shall be disposed of through shredding, while digital files shall be anonymized.

Consent

By completing the Philippine National Standards (PNS) Request Form and clicking "submit", or by personally submitting your order to the BPS Standards Data Center (BPS-SDC), you consent to the collection, use, storage and retention of your personal data by the DTI-BPS.

Governing Law

Any dispute arising in connection with this Privacy and Copyright Policy shall generally be governed by Philippine laws, particularly: the Data Privacy Act of 2012 (RA 10173); the Intellectual Property Code of the Philippines (RA 8293); as well as the issuances of the National Privacy Commission (NPC) and the Intellectual Property Office (IPO) of the Philippines, without prejudice to future applicable legislations.

As member representative to the International Organization for Standardization (ISO) and the International Electrotechnical Commission (IEC), the DTI-BPS adheres to the policies stipulated under the ISO POCOSA (Policy for the Distribution, Sales and Reproduction of ISO Publications and the Protection of ISO's Copyright). The copyright stipulations of the POCOSA shall apply to all ISO standards adopted as Philippine National Standards (PNS). The respective copyright rules of the international/regional standards shall also apply to those adopted as PNS.

All disputes arising in connection with this Privacy and Copyright Policy shall be filed before the appropriate court or tribunal within the Philippines.

Copyright

All page content on the BPS Standards and Conformance Portal are considered “work of the Government” and are therefore generally unprotected by copyright. However, prior approval of the DTI-BPS shall be necessary for exploitation of such work for profit. The office may, among other things, impose as a condition the payment of royalties.

The copyright exemption does not apply to all Philippine National Standards (PNS).

Sales of Philippine National Standard (PNS) and International Standards


TERMS AND CONDITIONS OF SALE

When you order a Philippine National Standard (PNS) or (an) ISO* standard, you accept these Terms and Conditions of Sale ("Sales Agreement") and the Customer License Agreement, so make sure you read all these terms before finalizing your purchase. 1. TAXES

The DTI-BPS’ price list for PNS does not include taxes. The ISO also does not include taxes in its price list for its international standards.


2. PAYMENT

The DTI Cashier accepts payment by cash or by Manager’s check for payment to the Department of Trade and Industry.


3. OFFICIAL RECEIPT

The DTI-BPS issues a payment slip for you to provide to the DTI-Cashier. It specifies the PNS or ISO that will be purchased and its cost. Upon payment to the DTI-Cashier, an official receipt is issued for your purchase.

The DTI-BPS refers to the issued official receipt prior to the release of the purchased PNS.


4. SHIPPING

As of the moment, the DTI-BPS only releases print/ hard copies of copyrighted and watermarked PNS, through its BPS Standards Data Centre. The DTI-BPS encourages you and other clients to directly arrange with couriers for the delivery of purchased PNS print copies. All orders for ISO international standards are through the DTI-BPS. Currently, the DTI-BPS sells the ISO international standards in paper format.

5. RETURNS POLICY

The DTI-BPS accepts returns of print copies of PNS that have unclear or blurred pages and lacking pages, among others.

The complaint must be submitted immediately not later than within six (6) months from the date of purchase. The customer should provide a copy of the official receipt, which proves that the standards were bought from the Standards Data Center.


6. DATA PROTECTION

See the Privacy Policy, which is incorporated into this Sales Agreement.


8. TERMINATION, LIMITATIONS AND GOVERNING LAW

See Clauses 7, 8 and 9 of the License Agreement, which are incorporated into this Sales Agreement.
