Pursuant to Section 6 of Republic Act (RA) No. 11229 known as the “Child Safety in Motor Vehicles Act”, the Department of Trade and Industry’s Bureau of Philippine Standards (DTI-BPS), for its part, drafted a Department Administrative Order (DAO) providing for the New Technical Regulation Concerning the Mandatory Product Certification of Child Restraint Systems.
The draft DAO was presented during the Public Consultation conducted by the DTI-BPS on October 30, 2019 at the Center Conference Room, 6F Trade and Industry Building, 361 Sen. Gil Puyat Ave., Makati City. The public consultation was led by DTI-BPS Officer-in-Charge (OIC) Neil P. Catajay who welcomed the attendees and accommodated their questions and suggestions. The details of the draft DAO were presented by Engr. John Steven M. Magboo, Trade-Industry Development Specialist of the Standards Conformity Division (SCD) of BPS.
As per RA No. 11229 and the draft DAO, a child restraint system refers to a device capable of accommodating a child occupant in a sitting or supine position. It is so designed as to diminish the risk of injury to the wearer, in the event of a collision or of abrupt deceleration of the vehicle, by limiting the mobility of the child's body.
The DAO aims to ensure that child restraint systems purchased in the market meet the specified safety requirements prescribed by the DTI-BPS by requiring all manufacturers and importers of child restraint systems to secure the Philippine Standard (PS) Safety Certification Mark License or the Import Commodity Clearance (ICC) certificate prior to the marketing, sale, and/or distribution of their products.
The draft DAO was based on Philippine National Standard (PNS) UNR 44:2018 and PNS UNR 129:2018. The draft regulation is available for download at the DTI-BPS website www.bps.dti.gov.ph while its reference standards are available for a minimal fee at the DTI-BPS Standards Data Center, 3F Trade and Industry Building, 361 Sen. Gil Puyat Ave., Makati City. All relevant stakeholders are requested to comment on the draft DAO until 29 November 2019.
